The Ministry of Electronics and Information Technology (MEITY) via a Press Note dated June 6, 2022 published the proposed amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules, 2021”) and sought public comments/feedback.
The Press Note also indicates the broad principles which are aimed:
- a) to make internet open, safe, trusted and accountable for all Indians using the internet.
- b) to ensure that online intermediaries providing services in India shall never contravene the Indian Constitution, Laws and Rules and follow them in letter and spirit.
- c) To ensure quick removal of unlawful and harmful information when reported; and
- d) To provide for a robust grievance redressal mechanism by providing an appellate forum.
Below are some of the changes which though targeted to achieve the goals, leave more questions than guidance and require re-consideration before its implemented. The enclosed article details our comments and recommendations submitted to the Ministry for their consideration.
